Audit Your Hiring Process for 2021

Below are five areas of hiring procedures California employers should review for 2021.

  1. Do your employment applications request the appropriate information? Ensure that your application complies with California and local laws regarding criminal history and salary history information.

  2. Do you train your managers on questions they can and cannot ask during an interview? Among other things, managers should not ask candidates questions relating to criminal history or pay and benefits at their previous job(s). 

  3. Do you provide your California new hires with the mandatory notices? Clients enrolled in our HR On Demand program receive these notices in their customized compliance kit.

  4. Do you provide new hires with your company’s policies and agreements (employee handbook, confidentiality agreement, meal period waivers for shifts less than six hours, etc.)?

  5. Do you have the required labor law posters and wage order(s) displayed? According to the DFEH:

Any required Department of Fair Employment and Housing posters must be conspicuously displayed where they can be easily seen and read by all employees and job applicants. The text has to be large and legible enough to be easily read when posted.

Posters must be displayed at the following places:

  • At each location where a company has employees – offices, stores, warehouses, branches, etc.

  • At employment agencies, hiring offices and union halls.

  • On computers as long as the posters are posted electronically in a conspicuous place where employees will tend to see it.

If 10 percent or more of a company’s workforce speaks a language other than English, the posters must also be displayed in that language (or languages).
